Certain features of the Website and our services may require you to create an account, including booking appointments through our Website or our mobile application (the “App”). When you create an account, you agree to: provide accurate, current, and complete information during registration; maintain and promptly update your account information; maintain the security and confidentiality of your login credentials and not share your account; accept responsibility for all activities under your account; notify Degree Wellness immediately of any unauthorized use.
Degree Wellness reserves the right to suspend, disable, or terminate your account at any time, with or without cause and with or without notice, including if we determine in our sole discretion that you have violated any provision of these Terms.
The services and nutrients offered by Degree Wellness, including but not limited to cryotherapy, infrared sauna, cold plunge, red light therapy, contrast therapy, IV therapy, nutrient shots, NAD+ therapies, compression massage, oxygen therapy, and light facials (collectively, “Wellness Offerings”), are not medical treatments and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Certain clinical services, including IV therapy, nutrient injections, and NAD+ therapy, may be administered by or under the supervision of Wellness Provider Therapies, PA, or its affiliates, a licensed healthcare provider that partners with Degree Wellness. The clinical judgment, medical oversight, and delivery of such clinical services are the sole responsibility of Wellness Provider Therapies, PA and its licensed practitioners.
The statements made on this Website regarding Wellness Offerings have not been evaluated by the U.S. Food and Drug Administration (FDA). Degree Wellness does not provide medical advice. You should always consult your own physician, licensed healthcare provider, or other qualified medical professional before beginning any new wellness program, treatment, or service, particularly if you are pregnant, nursing, have a pre-existing medical condition, or are taking prescription medication.
Assumption of Risk. You acknowledge and agree that participation in any Wellness Offerings involves inherent risks, including but not limited to risks of physical injury or even death, adverse reactions, skin irritation, burns, frostbite, dizziness, fainting, allergic reactions, and other complications. By booking, scheduling, or participating in any Wellness Offerings, you voluntarily assume all risks of injury, illness, damage, or loss that may result from your participation, whether or not caused by the negligence of Degree Wellness, its franchisees, employees, agents, or contractors.
Waiver and Release. To the fullest extent permitted by applicable law, you hereby release, waive, discharge, and covenant not to sue Degree Wellness, its parent companies, franchisees, subsidiaries, affiliates, officers, directors, employees, agents, and contractors from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury that may be sustained by you in connection with your participation in any Wellness Offerings, whether caused by negligence or otherwise.
Additional waivers, consent forms, or health questionnaires may be required prior to receiving specific Wellness Offerings at individual Degree Wellness locations. Those waivers supplement but do not replace this Section.
Healthcare Provider Services. To the extent clinical services are provided by Wellness Provider Therapies, PA, or its affiliates, the collection and use of your protected health information (PHI) is governed by the Wellness Provider Therapies, PA Notice of Privacy Practices, not these Terms. You may be asked to sign separate consent forms and acknowledgments required by Wellness Provider Therapies, PA and applicable healthcare regulations. Degree Wellness is not responsible for the clinical decisions, medical advice, or professional conduct of Wellness Provider Therapies, PA or its licensed practitioners.
This Website and all of its contents, features, and functionality (including but not limited to the information, software, text, displays, images, video and audio, and the design, selection, and arrangement thereof) are the property of Degree Wellness and other suppliers of such material and are protected by U.S. and international copyright, trademark, and other intellectual property rights laws.
The Degree Wellness name and all related names, logos, product and service names, designs, and slogans are trademarks of Degree Wellness. You must not use such marks without the prior written permission of Degree Wellness.

You agree to defend, indemnify, and hold harmless Degree Wellness, its parent companies, franchisees, subsidiaries, affiliates, service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the Website or any Wellness Services; (c) any use of the Website’s content, services, and products other than as expressly authorized in these Terms; (d) your use of any information obtained from the Website; or (e) your violation of any applicable law or the rights of any third party.
Governing Law. These Terms and any dispute or claim arising out of or related to these Terms, the Website, or any Wellness Services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
Mandatory Arbitration. Any dispute, controversy, or claim arising out of or relating to these Terms, including the breach, termination, or validity thereof, shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules then in effect. The arbitration shall take place in Duval County, Florida, or at another mutually agreed location. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Each party shall bear its own costs of arbitration, except that Degree Wellness will pay the arbitration filing fees if required by the AAA Rules.
Class Action Waiver. YOU AND DEGREE WELLNESS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.
Jury Trial Waiver. TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND DEGREE WELLNESS EACH WAIVE THE RIGHT TO A JURY TRIAL IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS OR THE WEBSITE.
Exceptions. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights. Claims that qualify for small claims court in the jurisdiction of your residence may also be brought in small claims court.
Degree Wellness shall not be liable or responsible for any failure or delay in the performance of its obligations under these Terms where such failure or delay results from any cause beyond Degree Wellness’s reasonable control, including but not limited to acts of God, fire, flood, earthquake, epidemic, pandemic, governmental actions or orders, war, terrorism, riot, labor conditions, power failures, Internet or telecommunications disruptions, or failures of third-party service providers. During such events, Degree Wellness’s obligations under these Terms shall be suspended to the extent necessitated by the event.
No waiver by Degree Wellness of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Degree Wellness to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
These Terms, together with our Privacy Policy and any applicable service waivers or consent forms executed at individual Degree Wellness locations, constitute the sole and entire agreement between you and Degree Wellness with respect to the Website and the Wellness Offerings described herein, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the Website.

Certain health information collected by our affiliated healthcare provider, Wellness Provider Therapies, PA, may be exempt from the CCPA/CPRA to the extent it is protected under HIPAA. For non-HIPAA health information collected directly by Degree Wellness, we use sensitive personal information only for the purposes of providing and improving our Wellness Offerings and as otherwise permitted under the CCPA/CPRA. You have the right to limit our use of sensitive personal information.
California “Shine the Light” Law
California Civil Code § 1798.83 permits California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please contact us using the information in Section 18 (“Contact Us”).

Overview of Health Data Collection
In connection with certain Wellness Offerings, health-related information may be collected by two separate entities, each with distinct privacy obligations:
HIPAA-Protected Information
When you receive clinical services administered by or under the supervision of WPT or another licensed healthcare provider, the health information you provide – including medical history, current medications, allergies, lab results, treatment records, and related clinical data – is considered protected health information (“PHI”) under the Health Insurance Portability and Accountability Act (“HIPAA”) and applicable state law.
This PHI is governed by the WPT Notice of Privacy Practices (“NPP”), not this Privacy Policy. A copy of the NPP will be provided to you prior to or at the time of your first clinical service and is available upon request. The NPP describes how WPT may use and disclose your PHI, your rights with respect to your PHI, and the legal duties of WPT regarding your health information.
Degree Wellness Franchise, LLC and each individually owned and operated Degree Wellness franchise location are business associates of WPT under HIPAA. Each entity has executed a Business Associate Agreement (“BAA”) with WPT governing the receipt, maintenance, transmission, and use of PHI. As business associates, Degree Wellness Franchise, LLC and its franchisees will use and disclose PHI only as permitted by the applicable BAA, HIPAA, and applicable law. Business associate obligations include implementing appropriate administrative, physical, and technical safeguards to protect PHI, reporting any security incidents or breaches of unsecured PHI, and ensuring that any subcontractors who access PHI agree to the same restrictions and conditions.
Non-HIPAA Health and Wellness Information
Degree Wellness also collects health-related information that is not subject to HIPAA. This includes general wellness preferences, non-clinical intake questionnaires, service history for non-clinical Wellness Offerings (e.g., cryotherapy frequency, sauna preferences), and information you voluntarily share with Degree Wellness staff outside the context of clinical services provided by WPT.
This non-HIPAA health information is protected under this Privacy Policy and applicable state laws. Degree Wellness uses this information solely for the purposes of safely delivering Wellness Offerings, customizing your experience, and complying with applicable laws. We do not sell non-HIPAA health and wellness data or share it for advertising purposes.
State Health Data Protections
Certain state laws, including the Washington My Health My Data Act, may provide additional protections for health-related information beyond HIPAA. These laws may apply to both HIPAA-covered and non-HIPAA health data depending on the jurisdiction. If you are a resident of a state with such protections, we will comply with the applicable requirements, including obtaining separate consent before collecting or sharing your health data where required. WPT will separately comply with applicable state health privacy laws as they pertain to PHI.
Your Rights Regarding Health Information
For HIPAA-protected information collected by WPT: Your rights are governed by HIPAA and described in the WPT Notice of Privacy Practices. These rights include the right to access your PHI, request amendments, receive an accounting of disclosures, and request restrictions on certain uses and disclosures. For non-HIPAA health information collected by Degree Wellness: Your rights are described in Section 9 of this Privacy Policy (“Your Privacy Rights”) and include the right to access, delete, and correct your information.
